Appellate Attorneys for Ezekiel Elliott Seek En Banc Review and New Restraining Order

The Ezekiel Elliott suspension saga continues with his appellate attorneys seeking en banc review by the full Fifth Circuit Court of Appeals. According to ESPN, Elliott's appellate attorneys are asking the entire Fifth Circuit to review the recent decision issued by that court reinstating Elliott's suspension. The decision reinstated the suspension by ruling that the Texas lower federal court did not have jurisdiction to enjoin the suspension.
While Elliott's attorneys are seeking en banc review by the Fifth Circuit, they have also filed papers seeking a stay of the suspension in the Southern District of New York. In the New York filing, Elliott's attorneys argue that the federal judge in Texas already held twice that Elliott will suffer irreparable harm if he is suspended for six games. They further argue that the Fifth Circuit Court of Appeals' decision was based on jurisdictional issues and never addressed the merits, and as such, the court in New York should enjoin the suspension.
