Federal Appellate Court Upholds $43 Million Dollar Award Against Nassau County

Appellate attorneys for two Nassau County men have won an appeal upholding a $43 million dollar award against Nassau County. According to the New York Law Journal, the Second Circuit upheld the award by a Brooklyn federal jury which awarded $36 million to the men for malicious prosecution and nearly $5 million for legal fees.
The civil rights case was brought by John Restivo and Dennis Halstead who each spent 18 years in prison for the rape and murder of 16-year-old. The two men were wrongfully convicted and were cleared by DNA evidence. The jury awarded the two men "$1 million for each year they were in prison for malicious prosecution and denial of a fair trial" along with their legal fees.
